TERMS & CONDITIONS (TERMS OF SERVICE)
OVERVIEW
Welcome to EDIT8 COLLECTIVE (“we”, “us”, “our”). These Terms & Conditions (also referred to as the “Terms of Service” or “Terms”) govern your use of our website and any purchase of products or services from EDIT8 COLLECTIVE (the “Services”).
By accessing our Services or placing an order, you agree to these Terms and our Privacy Policy.
EDIT8 COLLECTIVE is powered by Shopify. Any purchase you make through our store is made directly with EDIT8 COLLECTIVE, not Shopify.
ELIGIBILITY & ACCOUNT SECURITY
You must be at least 18 years old (or the age of majority where you live) to place orders. You are responsible for maintaining the confidentiality of any account login details and for all activity under your account.
PRE-OWNED, VINTAGE & CONDITION DISCLOSURES
Many items sold by EDIT8 COLLECTIVE are pre-owned and/or vintage. Items may show signs of wear consistent with age and prior use.
We aim to describe condition accurately with photographs and written disclosures. By purchasing, you acknowledge that:
- minor variations, patina, and age-related characteristics may exist; and
- product appearance (including colour) may vary by device/screen settings.
AUTHENTICITY & VERIFICATION
We take authentication seriously and apply a conservative assessment process. Where used, third-party authentication is referenced accurately and documentation retained.
If you have an authenticity concern, you must contact us in writing as soon as practicable with clear supporting information. We may request photographs and/or require the item be returned for inspection and/or independent assessment.
If an item sold by EDIT8 COLLECTIVE is confirmed to be not authentic, we will provide an appropriate remedy, which may include a full refund upon return of the item.
PRODUCT LISTINGS, PRICING & AVAILABILITY
All descriptions, photographs, and prices are subject to change without notice. We may correct errors (including pricing or availability) and cancel orders impacted by errors.
ORDERS
Placing an order is an offer to purchase. We may accept or decline any order at our discretion (including for suspected fraud or stock issues). An order is only accepted when we confirm it (including processing payment).
If we cancel an accepted order, we will notify you and refund amounts paid.
PAYMENTS
You agree to provide current, complete and accurate payment and purchase details. Payment processing may be handled by Shopify and/or third-party payment providers.
SHIPPING, DELIVERY & RISK
Shipping timeframes are estimates only. Delays can occur due to carriers, customs (for international orders), or events outside our control.
Risk in the goods passes to you once the order is handed to the carrier, except where Australian Consumer Law provides otherwise. If signature-on-delivery is selected or required for high-value items, you are responsible for ensuring someone is available to sign.
RETURNS & REFUNDS
Returns and refunds are governed by our Refund Policy (linked in the footer and in Shopify policy links). We comply with Australian Consumer Law.
PROMOTIONS & DISCOUNTS
Any promotion terms will be stated at the time of the promotion. If there is inconsistency between promotion terms and these Terms, promotion terms apply.
INTELLECTUAL PROPERTY & TRADEMARKS (NON-AFFILIATION)
All website content (text, layout, graphics, imagery not belonging to brands, and branding) is owned by or licensed to EDIT8 COLLECTIVE.
Designer brand names and trademarks are used for identification purposes only. EDIT8 COLLECTIVE is not affiliated with, endorsed by, or associated with any brand featured.
PROHIBITED USE
You must not misuse the Services (including scraping, interfering with site security, attempting unauthorised access, or using the site for unlawful conduct).
LIMITATION OF LIABILITY
To the maximum extent permitted by law, we exclude liability for indirect or consequential loss. Nothing in these Terms limits any rights or remedies you may have under Australian Consumer Law that cannot be excluded.
INDEMNITY
You agree to indemnify EDIT8 COLLECTIVE for losses arising from your breach of these Terms or misuse of the Services, to the extent permitted by law.
CHANGES TO TERMS
We may update these Terms from time to time. The latest version will be posted on this page.
GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of NSW.
